TERMS OF SERVICE
If you are using the Site or Services and you reside in the province of British Columbia, you are contracting with Vancouver Short Stay Apts. Inc. (Vancouver Short Stay Apts. Inc. is hereinafter referred to as “Vancouver Short Stay", "we", "us", or “our”) with respect to use of the Vancouver Short Stay Site or Services.By listing with Vancouver Short Stay, you confirm, understand and agree that you have listed your vacation and/or travel accommodation for the purposes of short term accommodation.Vancouver Short Stay’s activities are limited to facilitating a connection between Guests and Host properties, and facilitating transactions for Short Term Accommodation.Vancouver Short Stay has no control over the conduct of Hosts or Guests, and disclaims all liability in this regard to the maximum extent permitted by law.Failure to use the Site and Services in accordance with these Terms may subject you to civil and criminal penalties.
Definitions
"Guest" means a Member who requests from a Host a booking of an Accommodation via the Site or Services, or a Member who stays at an Accommodation and is not the Host for such Accommodation.
"Host" means a Member who creates a Listing via the Site and Services.
“Liaison” means a person who is authorized to act on behalf of a Host or Guest.
"Member" means a person who completes Vancouver Short Stay’s account registration process, including but not limited to Hosts and Guests, as described under "Account Registration" below.
"Listing" means an Accommodation that is listed by a Host as available for rental via the Site and Services.
“Short Term Accommodation" means any furnished Accommodation that accepts guest reservations with the understanding that Guests will not register a Host’s Listing as a primary residence, but is strictly being used in a temporary fashion as a vacation or travel accommodation.Reservation lengths may vary from a few days to multiple months.
YOU ACKNOWLEDGE AND AGREE THAT BY USING THE SITE, SERVICES, OR BY SUBMITTING ANY CONTENT TO VANCOUVER SHORT STAY, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED WITH VANCOUVER SHORT STAY.IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SERVICES.If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.If you accept or agree to these Terms on behalf of a Guest, you represent and warrant that you have the authority to bind that Guest to these Terms and, in such event, "you" and "your" will refer and apply to that Guest.
Modification
Vancouver Short Stay reserves the right, at its sole discretion, to modify the Site or Services or to modify these Terms, including the Service Fees, at any time and without prior notice. If we modify these Terms, we will either post the modification on the Site or otherwise provide you with notice of the modification. We will also update the "Last Updated Date" at the top of these Terms. By continuing to access or use the Site or Services after we have posted a modification on the Site or via the Application or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site and Services.
How Vancouver Short Stay Works
Vancouver Short Stay is a marketplace and limited payment agent for Guest reservations that are approved directly by Hosts.Vancouver Short Stay facilitates transactions and connections between Hosts and Guest for short term accommodation and vacation properties.
The Site and Services can be used to facilitate the listing and booking of Short Term Accommodations, Vacation, and other properties ("Accommodations"). Such Accommodations are included in Listings on the Site and Services by Hosts. You may view Listings as an unregistered visitor to the Site and Services; however, if you wish to book an Accommodation or create a Listing, you must first register to create a Vancouver Short Stay Account (defined below).
As stated above, Vancouver Short Stay makes available an online platform or marketplace with related technology for Guests and Hosts to meet online and arrange for bookings of Accommodations directly with each other. Vancouver Short Stay is not an owner or operator of properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or Accommodations, nor is it a provider of properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or Accommodations and Vancouver Short Stay does not own, sell, resell, furnish, provide, rent, re-rent, manage and/or control properties, including, but not limited to, hotel rooms, motel rooms, other lodgings or Accommodations, or delivery, cleaning, transportation or travel services. Unless explicitly specified otherwise in the Vancouver Short Stay platform, Vancouver Short Stay's responsibilities are limited to: (i) facilitating the availability of the Site and Services and (ii) serving as the limited payment collection agent of each Host for the purpose of accepting payments from Guests on behalf of the Host. Vancouver Short Stay is not a party to any agreements entered into between Guests and Hosts, nor do we act as a booking or travel agent, manage any properties, or book Accommodations on behalf of any consumers.You understand and agree that by using our Site and Services that you accept these terms, do not regard, and have not engaged with Vancouver Short Stay as a property manager, booking agent, or travel agent.
PLEASE NOTE THAT, AS STATED ABOVE, THE SITE AND SERVICES ARE INTENDED TO BE USED TO FACILITATE HOSTS AND GUESTS CONNECTING AND BOOKING ACCOMMODATIONS DIRECTLY WITH EACH OTHER. VANCOUVER SHORT STAY CANNOT AND DOES NOT CONTROL THE CONTENT CONTAINED IN ANY LISTINGS AND THE CONDITION, LEGALITY OR SUITABILITY OF ANY ACCOMMODATIONS. VANCOUVER SHORT STAY IS NOT RESPONSIBLE FOR AND DISCLAIMS ANY AND ALL LIABILITY RELATED TO ANY AND ALL LISTINGS AND ACCOMMODATIONS. ACCORDINGLY, ANY BOOKINGS WILL BE MADE OR ACCEPTED AT THE MEMBER'S OWN RISK.
Account Registration
As a Guest or Host, you must apply for a Vancouver Short Stay account.This process may include, but is not limited to, accepting information pertaining to your particular listing or listings, accepting photographs or facilitating professional photography, emails, and telephone calls.Vancouver Short Stay reserved the right to, at any point in the registration process, decline a Membership, Listing, Host, or Guest account.
Vancouver Short Stay recommends that Hosts obtain appropriate insurance for their Accommodations. Please review any insurance policy that you may have for your Accommodation carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Guests (and the individuals the Guest invites to the Accommodation, if applicable) while at your Accommodation.
Vancouver Short Stay may offer Hosts the option of having photographers take photographs of their Accommodations. If you as a Host choose to have a photographer do this, the photographs taken will be made available to you to include in your Listing with a watermark or tag bearing the words "VancouverShortStay.com Verified Photo" or similar wording ("Verified Images"). You agree that you alone are responsible for ensuring that your Listing is accurately represented in the Verified Images. You alone are responsible for using the Verified Images and you warrant that you will cease to use the Verified Images or any other images if such images cease to accurately represent your Listing. All images, materials and content created by these photographers, including Verified Images, constitute Vancouver Short Stay Content, regardless of whether you include them in your Listing. You agree that Vancouver Short Stay may use the Verified Images for advertising, marketing, commercial and other business purposes in any media or platform, whether in relation to your Listing or otherwise, without further notice or compensation.
Guest Reservation, Bookings, and Financial Terms
Definitions
“Accommodation Fees” means the price set directly by a Host for his or her listing, payable by the Guest in exchange for a Guest’s stay in an accommodation.The Host is solely responsible for setting the price of Accommodation Fees.
"Guest Fees" means the fee that Vancouver Short Stay charges a Guest for the use of the Services, which is calculated as a percentage of the applicable Accommodation Fees.
"Display Fees" means the fee that Vancouver Short Stay charges a Guest, and is displayed as total which is calculated as a percentage of the applicable Accommodation Fees plus the Accommodation Fees.This fee is charged to cover the costs associated with credit card merchants and other merchant or banking transaction fees, which can be significant for larger Accommodation Fee amounts.The Display Fees will be shown to the Guest when the Guest is asked whether to send a booking request to a Host.If applicable, for Recurring Payments (defined below), an amount which is part of the Total Fees may be shown as a single amount to a Guest before a booking request is made.
"Host Fees" means the fee that Vancouver Short Stay charges a Host for the use of the Services, which is calculated as a percentage of the applicable Accommodation Fees. The Host Fees will be displayed to the Host when the Host is asked whether to confirm or reject a booking request from a prospective Guest.
"Service Fees" means collectively the Guest Fees, Display Fees, and the Host Fees.
"Total Fees" means collectively the Accommodation Fees, Display Fees, and the Guest Fees.
Booking a Guest Reservation
As a Host, you understand and agree that once a Guest requests a booking of your Accommodation, you may not request the Guest to pay a higher price than in the booking request.You also agree that you alone are responsible for accepting Guests.Vancouver Short Stay claims no liability in this regard.When a potential Guest makes an inquiry for reservation of your Listing, you will be forwarded any information provided by the guest excluding any contact information.You may at any point prior to a Guest booking for your accommodation, accept or decline any inquiry.Once a Guest reservation has been accepted, you will then be forwarded contact information so that you may proceed in arranging any finer details related to Guest arrival and reservation of your listing.
House Rules
If you, as a Guest, choose to enter into a transaction with a Host for the booking of an Accommodation, you agree and understand that you will be required to enter into an agreement with the Host and you agree to accept any terms, conditions, rules and restrictions associated with such Accommodation imposed by the Host.These same terms, conditions, rules and restrictions will be made available after confirmation of a reservation either before your arrival as Guest via electronic format, or upon arrival to such Accommodation for you to sign and acknowledge.You acknowledge and agree that you, and not Vancouver Short Stay, will be responsible for performing the obligations of any such agreements, that Vancouver Short Stay is not a party to such agreements, and that, with the exception of its payment obligations hereunder, Vancouver Short Stay disclaims all liability arising from or related to any such agreements. You acknowledge and agree that, notwithstanding the fact that Vancouver Short Stay is not a party to the agreement between you and the Host, Vancouver Short Stay acts as the Host's payment collection agent for the limited purpose of accepting payments from you on behalf of the Host. Upon your payment of the Total Fees to Vancouver Short Stay, your payment obligation to the Host for the Accommodation Fees is extinguished, and Vancouver Short Stay is responsible for remitting the Accommodation Fees (less the Host Fees), in the manner described in these Terms. In the event that Vancouver Short Stay does not remit any such amounts as described in these Terms, such Host will have recourse only against Vancouver Short Stay.
Security Deposits
Hosts may choose to include security deposits in their Listings ("Security Deposits”).Each Listing will describe whether a Security Deposit is required for the applicable Accommodation. If a Security Deposit is included in a Listing for a confirmed booking of an Accommodation, and a Host makes a claim against such Security Deposit, Vancouver Short Stay will, in its capacity as the payment collection agent of the Host, use its commercially reasonable efforts to charge the Guest's payment method in the amount of the Security Deposit, within a reasonable period of time after the Guest's check-out from the Host's Accommodation. Vancouver Short Stay will also use its commercially reasonable efforts to address Hosts' requests and claims related to Security Deposits, but Vancouver Short Stay is not responsible for administering or accepting any claims by Hosts related to Security Deposits, and disclaims any and all liability in this regard.
Acceptable Loss
Items belonging to a Hosts Accommodation will be used in varying degrees by different Guests.As a Host, you agree and acknowledge that an acceptable loss may be incurred for certain items including, but not limited to, light bulbs, coat hangers, and other items in your listing that may depreciate over time as part of normal wear and tear during each guest reservation.
Damage to Accommodations
As a Host, you may claim an amount reasonable and necessary to repair damages to a Listing caused by misconduct of a Guest that exceeds fair use, wear, and tear, or to remedy any other default by a Guest with respect to a Booking.If you claim any portion of the Security Deposit, you agree to submit, by email, to Vancouver Short Stay Apts. Inc. a written accounting of each claim, along with all accompanying photographs of the claim or claims in question, and photographs of any original receipts, within ninety six (96) hours of the Guest’s departure from your Listing.If no claim is made within ninety six (96) hours of a Guest departure, then you waive all rights to make a claim against said deposit and any deposit amount if applicable will be released to the Guest within a reasonable period of time no greater than five (5) business days.
As a Host, you are responsible for setting a fee for damages due to smoking inside a Listing.A Host may choose to request an amount from the Security Deposit to remedy any damage, and in the interest of addressing the health concerns of future Guests.Vancouver Short Stay does not condone or accept any smoking inside any Listing.All Listings, including but not limited to their contents and personal possessions, are Listed by a Member at their own risk and as a Member or Host you understand and agree that Vancouver Short Stay claims no liability in this regard.Placement of such items during a Guest reservation in your listing is done at your own risk.Please use your best discretion.
As a Guest, you, and any individuals that you allow access to your reserved Accommodation, are responsible for Damages to said Accommodation.If in the event that a Host claims damages to his or her accommodation, and the Host submits evidence to Vancouver Short Stay, including but not limited to photographs, you, as the Guest, agree to pay the cost of replacing the damaged items with equivalent items.After being notified of the claim and given forty eight (48) hours to respond, a charge will be made to any Security Deposit provided by the Guest.You agree that, as a Guest, you will be responsible for providing any claim amount that exceeds the Security Deposit amount, and permit Vancouver Short Stay to attempt to collect and forward said claim amount including but not limited to loss of accommodation fees caused by breach of terms according to the Host’s cancellation policy.Security Deposits accrue no interest for furnished Short Term Accommodation.
If you are a Guest, you understand and agree that Vancouver Short Stay may make a claim under your homeowner's, renter's or other insurance policy related to any damage or loss that you may have caused or been responsible for or to an Accommodation or any personal or other property located at an Accommodation. You agree to cooperate with and assist Vancouver Short Stay in good faith, and to provide Vancouver Short Stay with such information as may be reasonably requested by Vancouver Short Stay, in order to make a claim under your homeowner's, renter's or other insurance policy, including, but not limited to, executing documents and taking such further acts as Vancouver Short Stay may reasonably request to assist Vancouver Short Stay in accomplishing the foregoing.
Both Guests and Hosts agree to cooperate with and assist Vancouver Short Stay in good faith, and to provide Vancouver Short Stay with such information and take such actions as may be reasonably requested by Vancouver Short Stay, in connection with any complaints or claims made by Members relating to Accommodations or any personal or other property located at an Accommodation or with respect to any investigation undertaken by Vancouver Short Stay or a representative of Vancouver Short Stay regarding use or abuse of the Site or the Services. If you are a Guest, upon Vancouver Short Stay's reasonable request, and to the extent you are reasonably able to do so, you agree to participate in mediation (described below) or similar resolution process with a Host, at no cost to you, which process will be conducted by Vancouver Short Stay or a third party selected by Vancouver Short Stay or its insurer.
Both Guests and Hosts agree that no such claim against a deposit shall include jewellery, artwork, credit cards, cash, or identification (‘Valuables’).Vancouver Short Stay recommends that you, as a Guest or Host, take any precautions necessary to protect valuables and irreplaceable items and Vancouver Short Stay disclaims all liability related to the loss of any Valuables.Should this for some reason or another occur, contact your local authorities immediately to submit a report.
Appointment of Vancouver Short Stay as Limited Payment Agent
Each Host hereby appoints Vancouver Short Stay as the Host's limited payment collection agent solely for the purpose of accepting the Total Fees from Guests.
Each Host agrees that payment made by a Guest through Vancouver Short Stay, shall be considered the same as a payment made directly to the Host, and the Host will make the Accommodation available to the Guest in the agreed-upon manner as if the Host has received the Accommodation Fees. Each Host agrees that Vancouver Short Stay may, in accordance with the cancellation policy selected by the Host and reflected in the relevant Listing, (i) permit the Guest to cancel the booking and (ii) refund (via Vancouver Short Stay) to the Guest that portion of the Accommodation Fees specified in the applicable cancellation policy. Each Host understands that as Vancouver Short Stay accepts payments from Guests as the Host's limited payment collection agent and that Vancouver Short Stay’s obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guests. Vancouver Short Stay does not guarantee payments to Hosts for amounts that have not been successfully received by Vancouver Short Stay from Guests. In accepting appointment as the limited authorized agent of the Host, Vancouver Short Stay assumes no liability for any acts or omissions of the Host.
Recurring Payments
Guests may be required to make recurring, incremental payments toward the Total Fees owed for a confirmed booking before beginning his or her stay at the applicable Accommodation (collectively, "Recurring Payments").If Recurring Payments apply to a confirmed booking, then the Guest authorizes Vancouver Short Stay, on behalf of the Host, to collect the Total Fees and the Host agrees that such Vancouver Short Stay entity will initiate payouts to the Host, in the increments and at the frequency associated with the applicable Recurring Payments, each as identified through our Services.
Cancellations and Refunds
If, as a Guest, you choose to cancel your reservation, you agree that the Host’s cancellation policy will apply and you have read and understand, prior to reserving a Listing, your Host’s cancellation policy.If a reservation is cancelled, Vancouver Short Stay will immediately cancel any future Recurring Payments according to the Host’s cancellation policy.As a Host, you understand that Vancouver Short Stay is not liable for collecting Recurring Payments after Guest cancellation, and you hold Vancouver Short Stay and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, debts, obligations, and expenses, including, without limitation, reasonable legal and/or accounting fees.If you wish to alter the dates of the reservation only after any payments have been made, the Host may choose to charge a cancellation fee (‘Cancellation Fee’), in addition to the terms in the Host’s cancellation policy, and may also require notice of at least thirty (30) days.
If, as a Host, you cancel your reservation with a Guest, you agree that a refund may be issued to the Guest for the period of time reserved by the Guest in the Host’s Listing.You agree that Vancouver Short Stay may apply penalties or consequences to you or your Listing, including (i) publishing an automated review on your Listing indicating that a reservation was cancelled, (ii) keeping the calendar for your Listing unavailable or blocked for the dates of the cancelled booking, or (iii) imposing a cancellation fee (to be withheld from your future payouts or charged to the credit card on file in your Vancouver Short Stay Account). You will be notified of the situations in which a cancellation fee applies before you decide to cancel.
Failure to Depart a Reservation
All Guests agree that a reservation is only a license to enter an Accommodation for a limited period of time.You agree that all reservations made between you and the Host through Vancouver Short Stay are strictly for the sole use of the Listing as Short Term Accommodation and you agree to leave the Accommodation at the agreed date of departure.If as a Guest you fail to leave the Accommodation, then you agree that you will be responsible for a nightly charge equal to double the Recurring Payments divided by thirty (30) and you authorize Vancouver Short Stay to charge your payment method indicated by you, or collect said fees at a later date.
Vancouver Short Stay recommends that, upon Guest arrival, Hosts have their Guests sign a mutual agreement to depart at the end of a reservation as indicated in your reservation documentation.Please make sure that you are familiar with and understand any inclusions and exclusions whether and when your local laws will serve to protect your Guests as tenants.Short Term Accommodation in nature is not designed for permanent residency.Vancouver Short Stay assumes no liability for any acts or omissions in this regard, and shall not be held accountable to resolve any dispute related to overstaying a reservation.Vancouver Short Stay shall, in its sole discretion, choose to assist a Host in this regard.
Payment Processing Errors
We will take steps to rectify any payment processing errors that we become aware of.These steps may include crediting or debiting (as appropriate) the same payment method used for the original payout to or payment by you, so that you end up receiving or paying the correct amount.
Reservation Fee Schedule, Due Dates, and Penalties
As a Guest, payments will be made on each due date as indicated in your Guest Itinerary.If payment is not able to be charged to your selected method of payment, or is not received within twenty four (24) hours of the due date, the Host may elect to apply a late fee (“Late Payment Fee”) for each day payment is not received or submitted from you as the Guest and you authorize Vancouver Short Stay to charge your payment method indicated by you, or collect said fees at a later date.
Guest Reservations and General Financial Terms
As a Guest, you understand that you have read, understand, and are bound by these Terms of Service.As stated above, you hereby acknowledge that you are being granted a license to access a Host’s Listing, and have entered a limited Guest Suite Agreement solely for the purposes of Short Term Accommodation, and agree that you may not assign, sublet, or misrepresent any information disclosed by you as the Guest for your reservation in any Listing.
If, as a Guest, you choose to leave a reservation early, you understand that any payments made toward the Total Fees are non-refundable in the event of early departure.You agree and understand that in paying for a reservation, the Host has lost the opportunity to respond to other reservation inquiries.Your suite has been locked in for your term of occupancy, all other prospective Guests will know that the suite is unavailable, and you understand that all Listings are not a venue where vagrant occupancy occurs.
If, as a Guest, at the time of departure, you do not leave and return keys, or any other device used to gain entrance to your confirmed Short Term Accommodation, you agree that you have rented the suite for an additional night and all associated fees will apply.A Host may choose to make a claim against your Security Deposit for keys not returned (or any other device used to gain entrance to the Accommodation) if he or she feels that may not return said keys or devices.You agree that you have not misrepresented the number of Guests for whom you have reserved a Listing, including yourself, and agree that without explicit consent of the Host that the Host may choose to decline your reservation at any point.Hosts may choose to display an extra guest fee (“Extra Guest Fee”) prior to booking his or her accommodation and Vancouver Short Stay, in it’s limited capacity as facilitator, will charge a Guest said Extra Guest Fee as part of the Total Fees at the time that your reservation is initially confirmed.You agree to pay any outstanding Extra Guest Fees, through Vancouver Short Stay, as a result of any error or omission for the correct number of Guests declared before a booking if permitted within a Listing as explicitly laid out by the Host prior to booking confirmation.
If, as a Guest, and during your reservation, you become absent from a Listing for a period greater than seven (7) days, you agree to notify the Host of any absence and will permit the Host to enter the Listing during the absence if necessary.During an emergency, it may be necessary for the Host to attempt to account for all Guests.
As stated above, as a Host, you agree that any information that you provide as part of your Listing will be truthful, accurate, and not misrepresent its contents, features, and/or amenities.You agree to represent your listing accurately and include items and appliances promised in a good and functioning condition.Once a reservation is confirmed, you may not add fees to your confirmed reservation such as, but not limited to, extra utilities fees.Certain hosts may choose to make their Accommodation pet friendly.Pets are only accepted during a reservation within a Listing with explicit permission from the Host.In this case, an additional pet fee (“Pet Fee“) will be applied by the Host for extra cleaning beyond the normal departure cleanup due to consideration of future Guests who may have allergies, and to account for extra wear and/or extra cleaning for such items as bedspreads, sofas, and carpets.
If, as a Host, your Guest cancels a confirmed booking or Vancouver Short Stay decides that it is necessary to cancel a confirmed booking, and Vancouver Short Stay issues a refund to the Guest in accordance with the Guest Refund Policy or other applicable cancellation policies, you agree that in the event you have already been paid Vancouver Short Stay shall be entitled to recover the amount of any such Guest refund from you, including by subtracting such refund amount out from any future Accommodation Fees due to you.
General Information
Arrival times are arranged directly between you, as a Guest, and the Host.Departure times are set in the same fashion.As a Guest you must make reasonable requests for service only (i.e. if an appliance ceases to function, it may take time to bring in a replacement if necessary).A Guest must not expect either immediate delivery or make unreasonable demands of the Host, but the Host agrees to remedy such event within a reasonable period of time.
A Host will specify if personal furniture is permitted in a Listing, and will specify whether items may be removed from a Listing.If special arrangements need to be made, the Host and Guest must make arrangements directly regarding any items intended to be moved and the Host must explicitly permit this.
Entering a Listing during the time it has been reserved by a Guest
As a Host, you agree to at all times give one (1) full day notice or twenty four (24) hours notice of your intent to enter your Listing, during reasonable hours, while a Guest has paid for and reserved your Listing, but such notice need not be given in the event of an emergency or where the Guest consents to the Host’s entry without such notice being given.Emergencies are, but are not limited to Fire, Flood, and an imminent danger to the Guest, during which immediate entry will be permitted by the Guest under these circumstances only.
Verification
Certain hosts may require any potential Guests to verify their identity in order to successfully make a Booking.Certain documents may be requested, including but not limited to Drivers Licenses, Passports, Permits, Student or Visa Numbers.
Member Conduct
By using our Site and Services you agree not to solicit your listing or make any private arrangement with relation to any Guest reservation, or that you will not attempt to do business directly with any Company or Liaison which is representing the Guest.Vancouver Short Stay pays for the cost of marketing and development in order to make these Companies and Guests aware of our Site and Services, and you agree to be bound by a non-compete agreement for these same Guests, Liaisons, Companies, and any other good will related to Vancouver Short Stay and its Members.
Privacy
Member information will not be shared with any third party, and your information as a Member of Vancouver Short Stay is kept private.Listing addresses, names, and contact information will only be shared with a potential Guest once a reservation has been confirmed and approved by you, the Host.Listings locations are anonymized prior to any Guest reservation confirmation.
Dispute Resolution
You and Vancouver Short Stay agree that any dispute, argument, or claim as a result of your activities with regard to this agreement and Vancouver Short Stay will be settled by binding arbitration.The neutral arbitrator is the Arbitrators Association of British Columbia (AABC).This association may be reached directly at http://www.labour-arbitrators.bc.ca/disputeresolution.html

THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN VANCOUVER SHORT STAY AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

The Vancouver Short Stay Referral Program (the “Program”) allows its Members to earn credits (“Stay Credits”) that can be used towards future reservations by referring friends to become new Host Members (“Hosts”) who list their accommodation and complete their first guest reservation (see Eligible Reservations). To participate in the Program, referred and referring Members must both agree to these terms which form part of the Vancouver Short Stay Terms of Service.
Referring a friend
In order to receive Stay Credits, a referred friend must i) click the referral link to create a valid account that complies with our Terms of Service, ii) the referred listing must meet our criteria for a Qualifying Listing (detailed below), and iii) the referred listing must successfully complete an Eligible Reservation with their first guest (detailed below).
Eligible Reservations
Stay Credits are issued upon completion of the referred listing’s initial reservation, and i) must span the duration of one month (or 28 nights), ii) all scheduled payments must be paid successfully and not refunded, and iii) the reservation must be valued at a minimum of $2,800 CDN before Vancouver Short Stay service fees and cannot include a cleaning fee.
Eligible Reservations must be created and paid for in full via the Vancouver Short Stay website, and the referred friend must complete the Eligible Reservation in full before the referring Member can receive Stay Credits. A reservation will not be considered an Eligible Reservation, and therefore no Stay Credits will be earned, if the referring Member is the Host, the Co-Host, part of the Host Member’s Team, if the reservation is cancelled at any time, or if any payments are refunded for the Eligible Reservation. Reservations made by a family member or friend are not considered eligible.
Stay Credits are issued only once per referred friend who completes an Eligible Reservation, and the number of Stay Credits that may be issued for that Eligible Reservation is indicated on our referrals page. The maximum number of Stay Credits that may be issued to any Member is $2,500 CDN or 10 referrals, whichever comes first.
Qualifying Listings
Vancouver Short Stay reserves the right to define and change the criteria for a Qualifying Listing at any time, and reserves the right to reject a listing at our sole discretion. The types of Qualifying Listings are indicated on our referrals page.
Multiple Referrals
A referred host must be a new, first-time member of Vancouver Short Stay. Referral benefits will not be issued if the referred person is an existing host. A referred person may only use one referral link for one listing. A listing may only be referred once and Stay Credits may only be issued once per listing. If a person receives more than one referral link, then one referral may only be used, Stay Credits will only be issued to the referral link used, and the remaining referral links will be terminated.
Combining and Selling Referrals
Stay Credits may not be combined, sold, resold, or purchased in any way. Vancouver Short Stay reserves the sole right to terminate Stay Credits if any of the aforementioned events have occurred.
Referral links and sharing
Please use our website to distribute and track referrals. Members are prohibited from spamming people with our referral links. This includes, but is not limited to, and at our discretion, any member inviting any person that they do not know by means of any message platforms, email services, bots, automated systems, and other technologies that may be developed in the future. Referral links may not be distributed on any commercial website, blog, or social site without our permission, and are not permitted to be posted to any form of paid advertising. If in our sole judgement we deem that your account is being misused, we may choose to exclude you from our referral program and/or decide to cancel your account. We have the final say with all referral decisions, and retain the right to deny referral credits.
Redeeming Stay Credits
Members who have Stay Credits may redeem them by calling Vancouver Short Stay, and Stay Credits may only be redeemed by the Member that they were issued to. Stay Credits expire after one year from being issued, and may be extended at Vancouver Short Stay’s sole discretion. Stay Credits have no cash value, cannot be combined with Stay Credits from another Member account, and may not be used for commercial purposes except in the case that a Member uses them to make a reservation.
Vancouver Short Stay may request additional information before allowing Stay Credits to be redeemed, reserves the right to any remedy, including cancellation of your account or reservations, if fraud, tampering, violations of these terms or Vancouver Short Stay’s Terms of Service, or technical errors are suspected, and all decisions regarding your Stay Credit balance will be final and at Vancouver Short Stay’s sole discretion. If your reservation later qualifies for a refund, the maximum refund you may receive is the amount you actually paid.
Severability
The provisions of these terms, whether or not contained in the same section, are independent and severable. The invalidity of any provision shall not affect the validity of any other provisions of these terms.
Termination
Vancouver Short Stay retains the right to terminate the Program at any time, and may choose to suspend any Member’s participation for any reason. We may choose to suspend any Member account or eliminate Travel Credits if we suspect fraud, abuse, discrimination, or if the Member is in violation of our Terms of Service.
Updates to Terms and Changes to Program
From time to time we may update these terms and post new ones on vancouvershortstay.com, and the new terms will become effective at the time of posting. We may also make changes to the Program at any time and without notice.
